Description
Summary:This paper aims to define the concept of a market participants' collective dominant position in the market, given that it is insufficiently explained and underdeveloped in the competition law of the Republic of Serbia, in contrast to its evolution in the competition law of the European Union. While harmonization between EU regulations and those of the Republic of Serbia has largely been achieved in accordance with the Stabilization and Association Agreement, their practical application in Serbia remains lacking. Therefore, this paper will analyze the concepts of a position of dominance and a collective dominant position in the market and provide a clearer definition of these terms.
