description The independentist discourse in Chile has got a deeply sanctimonius nature that is reflected by the Chilean legislation. This paper aims at studying the way the laws has the integrated the person of the worker in the public sector - as well the civil servant as the soldier - and also the worker in the private sector. If you just have a look on the Chilean laws, you will notice that if on one way, the civil servant was abundantly regulated, on the other way, the worker of the private sector was not directly part of Chilean laws in the 19th century. Thus, we will show the precocious creation of a “civil service” in Chile and we will show that the worker of the private sector even though he was not directly the object of particuliar laws is not excluded of the Chilean Law that indirectly regulates his person.
