Summary: | Indonesia’s new Criminal Code (KUHP), enacted in 2023. It will bring significant changes to the country’s legal system, particularly in the area of cybercrime. With the proliferation of digital crimes, the focus of the updated code is to strengthen Indonesia’s criminal code. Besides serving as a basis for criminal law, the new Code repeals a number of provisions of the previous legislation, particularly on cybercrime. This research uses a normative legal approach, analysing legal principles, systematics and relevant facts, with key legislation including Law No. 1 of 2024 on the Amendment of Law No. 11 of 2008 on Electronic Information and Transactions and Law No. 1 of 2023 on the Criminal Code. The amendments cover various aspects such as defamation and insults, blasphemy, privacy violations, threats and intimidation, moral offenses and pornography and other related cybercrimes. The amandments aim to better address the challenges of the digital age and reduce conflicts between the ITE law and the new Criminal Code. The research concludes that cybercrime in Indonesia is increase rampantly, exacerbated by the growing use of Artificial Intelligence. |
