The paper analyses the effective implementation of the Italian Law on assisted reproductive technologies (Law 40/2004). The main focus is the impact of the legislative framework on woman’s rights, with a special regard to the right to procreate and the right to health. The Italian regulation is analysed in the light of its implementation by judges, which have massively intervened on legislative contents, in order to guarantee the conformity with the Constitution and with woman’s rights.
En este artículo se analiza el desarrollo aplicativo de la ley italiana en materia de procreación humana asistida (Ley 40 de 2004), centrándose en el impacto que la intervención del legislador italiano ha provocado en los derechos de las mujeres, en particular, en el derecho a la procreación y a la salud. La regulación italiana será analizada en tanto aplicación jurisprudencial de la ley 40 que ha adecuado de forma masiva su contenido a fin de garantizar su conformidad a la Constitución y a los derechos de las mujeres que acceden a estas técnicas.
