Summary:China has issued a series of policies around the three-dimensional stratification of sea area use right, and has achieved certain practical achievements. This paper systematically summarizes the effect of the policy implementation, comprehensively studies the practical dilemmas and policy problems during the three-dimensional development of China’s sea area, explores the collaborative path between the policy and the practice, and provide theoretical support to the three-dimensional management of sea area space. The results show the key problems are lacking of differences in policy promotion of coastal provinces, lacking of coordination between development subjects, and lagging in relevant laws and regulations. In the implementation of the three-dimensional layered right to use the sea area policy must be comprehensively considered in the implementation of the policy of three-dimensional stratification of sea area use right, it is necessary to comprehensively consider the participation of the owner of the sea area right, the actual situation of the marine environment, and the adaptability and feasibility of the planning method, in order to rationally plan the sea area space and to construct and improve the sea area management coordination mechanism and relevant legal system.
