Summary: | Any model of criminal procedure is
designed to reflect the conceptual provisions of
the state’s criminal policy at a certain stage of
its development. Therefore, the content elements
of such a model, with a varying degree of
actualisation, should carry information about the
essence, target orientation, priorities and criteria
of effectiveness of normative and law enforcement
activities in the field of protection of the individual,
society and the state from criminal encroachments.
National criminal proceedings are no exception,
modelled on the optimal combination of strategies
designed to achieve the goal of stabilising and
limiting crime rates and creating preconditions
for positive crime trends. Purpose: to analyse
the problems of the development of criminalistic
knowledge through the prism of the concept of
the state’s criminal policy in the field of criminal
prosecution strategy. Methods: empirical methods
of comparison, description, interpretation;
theoretical methods of formal and dialectical logic;
specific scientific methods: system-structural,
formal-legal, comparative-legal, historical-legal.
An interdisciplinary approach is also applied
in the development of the article. Results: the
article identifies promising directions for the
development of criminalistic knowledge in the
implementation of a modern criminal prosecution
strategy. Such directions relate to the development
of appropriate recommendations to ensure the
activities of the subjects of criminal prosecution
during pre-trial and trial proceedings in a case
(including taking into account its complicated
procedural forms) on the background of modern trends of harmonising force and compromise
procedures of exposing criminals. |
