Description
Summary:The composition of water pollution sources according to the Criminal Code of the Russian Federation has been investigated. The greatest vulnerability of the aquatic environment from all components of the ecosystem has been noted. The objective and subjective signs of water pollution according to the Criminal Code of the Russian Federation have been analyzed. Taking into account the analysis of normative legal materials, legal practice, and literature, promising theoretical conclusions and proposals on improving the regulation of criminal liability for water pollution in the Criminal Code of the Russian Federation have been substantiated. Differentiation of criminal responsibility depending on the forms of guilt, providing for pollution of water bodies by not being careful in a separate article of the Criminal Code of the Russian Federation or in certain parts of articles 250-252 of the Criminal Code of the Russian Federation, has been recognized as promising. It has been also proposed to supplement article 250 of the Criminal Code of the Russian Federation, with part four, which should provide for a stricter sanction for water pollution resulting in the death of two or more persons by negligence. The qualification of water pollution, its delimitation from other related offenses have been performed.
