| description | Morocco's international private law statute, one of the oldest still in effect, remains in use despite the significant discord between the context of its adoption and the current legal environment in Morocco. This paper aims to elucidate the complexities faced by Moroccan jurists, particularly the challenges arising from inconsistencies in the personal status of foreigners. It explores the historical and legal foundations of Morocco's approach to international private law, with a focus on the personal status of foreigners. The paper examines the evolution of key principles such as qualification, public order, renvoi, and evasion of law, and their application to personal status matters. Utilizing a juridical normative approach with historical-descriptive characteristics, this qualitative research highlights the need for reform or clarification to address the confusion stemming from the integration of disparate legal provisions. The findings underscore the necessity for legal professionals and practitioners to navigate and potentially resolve the complexities of this blending of laws. |
