| description | This article considers the importance of language in the creation and definition of lesbian, gay, bisexual and transgender (LGBT) persons in the jurisprudence of the European Court of Human Rights (ECtHR) and the work of the Commissioner for Human Rights of the Council of Europe. More specifically, the article argues that the specific terms such as « homosexual » rather than « gay » or « transsexual » rather than « transgender » used in various contexts at the Council of Europe, may play a productive role in the definition of normalised and respectable LGBT persons and plaintiffs. By critically examining some strands of the case law of the EctHR, as well as the work of the Commissioner on issues relating to sexual orientation and gender identity, this article seeks to highlight how crucial is language is for the definition of the subject of human rights. |
